i) These Terms and Conditions apply to you, the Website user and your usage of Nick Scali Online and associated software, networks and processes, including the purchase of goods or services through the Website.
ii) By browsing the Website, or placing an Order, you agree to the following Terms and Conditions as set out below.
i) All prices listed on Nick Scali Online are in Australian Dollars unless otherwise specified
ii) All prices listed on Nick Scali Online include all applicable taxes unless otherwise specified.
iii) Prices are subject to change at any time. Once an order has been confirmed the price is then fixed.
iv) You agree to pay delivery charges as they are calculated and listed in the Order confirmation at the time of purchase.
v) Nick Scali Online reserves the right to refuse a sale
i) Features and specifications of Products on Nick Scali Online are conveyed as accurately as possible.
ii) All weights and dimensions mentioned are approximate.
i) An Order can be placed by completing the Order Form on the Nick Scali Online website at checkout and clicking the ‘confirm’ button. By placing an Order you agree to these Terms and Condition. Nick Scali Online will issue you an Order Number.
ii) An Order is classified as received by Nick Scali at the moment that Nick Scali Online sends an Order confirmation to the nominated e-mail address.
iii) Each Order represents a separate agreement with Nick Scali Limited
iv) It is the customer’s responsibility to ensure the correct contact details are entered and that the nominated e-mail address is regularly checked for correspondence.
v) Nick Scali Online cannot confirm the estimated delivery time based on commercial quantities placed through the Website
vi) Nick Scali Online reserves the right to cancel an Order at any time prior to dispatch of your item, including back-orders. In this event, you will be contacted by Nick Scali Limited and a store credit, refund or any other reasonable compromise equal in value to that of the cancelled Order will be provided.
vii) Nick Scali Online holds no responsibilities for declined Orders due to internet connection or customer computer system errors. If Orders continue to be declined, contact service and they will work with the customer to resolve such an issue.
i) Nick Scali Online currently accepts Visa/Mastercard through NAB Transact Direct Post and payment via Paypal.
ii) Payment for Orders will be processed immediately upon confirmation of your Order, including for Products on back-order.
iii) If your nominated payment method(s) is deemed as suspicious the transaction may be cancelled. Customer will be notified of any cancellation following payment.
i) Nick Scali Online is committed to ensuring a fast and reliable delivery service. All items that are in-stock aim to be shipped within 5-7 days of receiving payment, however this may be subject to change as a result of mitigating circumstances.
ii) A confirmation email will be sent to the customer when the Order has been shipped. Orders may be split and items shipped separately. You will be notified by service if this occurs.
iii) The ‘Estimate your delivery’ function enables you as a customer to obtain an estimated delivery time based on your location and availability of stock.
iv) A customer is still able to order goods that are not in stock. Delivery estimator will provide you with the expected in-stock date of that product.
v) The ‘Estimate your delivery’ function is purely an estimate. Delivery times & expected in-stock dates may change because of factors that are outside the control of Nick Scali Online.
vi) All deliveries will take place during normal business hours Monday to Friday (9:00 – 17:00)
If you are unable to accept delivery within the normal business hours we suggest you contact us email@example.com prior to the order or organise a time with the nominated courier upon receiving the shipping email confirmation from Nick Scali Online.
vii) Where delivery has been confirmed with the customer, there may be a re-delivery charge if no person is at the delivery address at the time of delivery confirmed or the delivery is cancelled by the customer on day of delivery.
viii) Nick Scali Online aims to ensure all goods in-stock are delivered promptly. However events may occur that are out of our control. Nick Scali Limited holds no liability for loss or damage suffered as a result of such circumstances that may delay you receiving your good(s).
ix) Nick Scali Online couriers are not responsible for packaging, In the event that your item requires installation or assembly please note that all original packagin is left with the customer.
Nick Scali Online will repair or replace damaged or faulty Goods in accordance with these Terms and Conditions and the applicable Warranty and Returns
i) Where a Good is faulty within the first 7 days after delivery or is damaged on delivery, the customer has 7 days from the time of receiving your good(s) to notify Nick Scali Online. Service can be contacted at firstname.lastname@example.org or 1300 880 370. In this scenario:
a. You will be required to provide an original receipt of purchase and/or send photos of the damage or fault.
b. An assessment by Nick Scali specialists will be carried out to confirm if the good is faulty.
c. Following assessment it will be at the discretion of Nick Scali Online to either:
1. Provide a replacement part
2. Provide a replacement product
d. Where Nick Scali Online is unable to offer a new replacement, Nick Scali has the option to offer a full or partial refund subject to the amount of damage
e. As a customer, for faulty goods received, you have the option for a full refund. However where a new replacement or replacement part can be provided, a refund in equal value to the amount of purchase price, less Delivery Cost and return Delivery Cost, will be provided.
ii) Outside of this 7 Day period, product faults will be dealt with in accordance with the conditions outlined in Warranties
iii) Nick Scali Online reserves the right of discretion in determining whether the good(s) are faulty, following the clauses (a-e) above.
iv) The purchaser must bear the expense of making the claim, and the cost of all freight, house calls, labour and other items. These will be charged to the purchaser at standard Nick Scali rates.
ii) The benefits to the purchaser under these defect warranties are in addition to other rights and remedies of the purchaser under the law.
iii) Nick Scali goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
i) All Intellectual Property in any Material on the Website is the property of Nick Scali Limited. Unless expressly authorised under this Agreement or otherwise, you may not reproduce adapt, modify, display, perform or distribute any Material or any part of any Material.
i) Nick Scali Online reserves the right to make changes to the Website and Order Terms and Conditions without notice.
ii) Any provision of this Agreement which is void or unenforceable may be severed from this Agreement without affecting the enforceability of other provisions.
iii) A failure or delay by Nick Scali to exercise a power or right under this Agreement does not operate as a waiver of that power or right, and the exercise of a power or right by Nick Scali does not preclude its future ability to exercise that or any other power or right.
